When a person dies, their home (or estate) goes through a legal process called probate. This is where the decedents estate is taxed by the government and divided up among the decedents family members, according to what is requested in the will. If the decedent never wrote out a will, then the probate court appoints an executor; the executor acts for the decedent by dividing up his or her assets, or property.

In some instances, a decedents estate never enters probate court, but this is only if the deceased had a living trust. If the deceased did not have a living trust, it then becomes the property of the spouse, but this rule only applies in states whose law says that a married couples estate is deemed community property.
